Except that they didn't bother asking the guy who owns the hair whether he'd mind if they borrowed it. He's thinking of taking legal action. He may have several claims of damage but he might be better off just going after them with a DCMA and maybe force the CIA to pay millions for infringement and then have their internet cut off!!

I have no idea what the laws would be like for something like this. DMCA may not even apply if the CIA can persuade the judge it falls under fair use. Chances are they got that photo using some funky CIA plug in to Google Images that compared Osama's likeness to everyone on the net. Either way, it would be an interesting case to follow as it could have many ramifications and not just to the CIA.
