Homeowners' association forcing man to take down 9-11 flag

Wentz lives in the Fairways at Heron Bay. The commemorative flag lists the names of everyone who died on Sept. 11, 2001, and is a replica of the ones placed in Battery Park during the 10th anniversary of the attacks.
"When I received the letter, I actually stood out in front of the house yelling in anger about it," Wentz said.
Wentz, a retired New York City police officer, said he ran into the Tower 1 and started pulling out people before the building collapsed. Wentz said he lost 43 friends and colleagues that day. The inside of his home is a shrine to the friends he lost.
Wentz now has cancer, he said, from breathing in all the particles during the cleanup of Ground Zero.

Outrageous! Moral of this story is, don't live anywhere with a homeowner's association!

The American Civil Liberties Union weighed in, saying that although homeowners associations are constitution-free zones, it has asked the state to limit what associations can do.
"This is an absurd, excessively literal interpretation of the rule. Why anybody would want to enforce that is beyond me," said Howard Simon with the ACLU.

I'll stay in my non-HOA area, thank you.
 
@Red, you're right. If you don't want to be subject to the homeowner's association then you are free to either not move into the homeowner area or move out.

How HOA are legal to begin with is beyond me. I'd rather put up with the odd neighbor with the piss yellow house and occasionally parks contruction equipment out front than live under tyranny in my own home.

People do have a right to associate as they will. It's the first ammendment. So if some homeowners want to band together then I'm all for them doing so. Though I personally wouldn't nor would take part.

It doesn't jive with property rights IMO. They can associate all they wish and do what they wish on their property. AFAIK in Florida a seller is not required to disclose to a buyer about any association. Buyer beware.

Sure it does. It's your property and your rights. So if you want to assign your rights to an external agency to determine then go for it. In Minnesota any associations must be disclosed. For example, Condominiums, are clearly, anywhere, an associative body by definition.
 
everyone now knows the Fairways at Heron Bay has morons living there (well, at least one)....I would make sure NEVER to move there, ever!
and I would warn others not to.

(Of course, I'm never moving, but that's beside the point)
