You left out, but it is in the article, the very important - in the State of Emergency. It's during this time that the Government suspends it's normal functions along with several rights and freedoms. I think your question is more properly should ask should we ever declare a State of Emergency? Under what conditions? And do we have the proper checks and balances to ensure that declaration is legit.

This goes to larger question - do we have the propert system in place to ascertain validity of a declared State of Emergency? Personally I think we do need the power to declare Emergencies. However, I don't think we have the proper processes to ascertain validity of the declarations.Just like avian flu and swine flu were "state of emergency"?
It's good to be a bit paranoid but you're a bit over the top. The Gov does have it's problems, certainly. Though the Gov does lots of things well. -- Free Public Libraries, NASA, FAA, Park Systems, Military, Court System, Highway systems, Statistical collections and reporting, CDC - I think we can agree that these things aren't perfect. I think what we'll find is these agencies lead the world, if not history of the world, in their endeavors. (NOTE: that list isn't inclusive just a 5 second quickie off the top of my head.)I don't trust government to get anything right and their motives are NOT in out best interest. Government should NEVER have authority over someone's child unless that person is terribly abusive.
