But, weird as it sounds, I have seen some of that cannibal fetishism (there are comics too) and it is a bit out there - but all things considered there are relatively few women being cooked and eaten. On the other hand - having the names of real people on your "to eat" list amps up the creepy factor a bit more.

I think the bit about this case is that it was starting to leave the realm of pure fantasy and edging towards reality. Besides, police aren't supposed to use their authority to look people up in their big-ass database either, which is illegal all on it's own. But doing so to place people on a menu, well, that's just a bit much.

The part about the menu is all about "intentionality" - that's a thought crime in many ways. Was he really going to kidnap and eat people. That is the weak thing to prosecute him on and they should probably just let that bit go.
Using the database for personal or improper reasons is clearly illegal and he should do time for that - that's what the case should be argued on.
However, I bet that angle won't be popular because I suspect everyone in law enforcement quite likes that access and would hate to see someone made an example of.

If it were only thoughts in his head, none of us would know about any of this right now. The problem is it went beyond pure thoughts, and he involved another guy. That's what a real conspiracy looks like, which is also illegal.
